The Pentagon got caught using its power to punish a company for speaking out against government AI policy, and a federal court called it exactly what it was — unconstitutional. Both the First and Fifth Amendments were violated when the Defense Department blacklisted Anthropic simply for refusing certain military uses of its tech. This ruling draws a hard line the entire AI industry needed.

A Biden-appointed judge just overruled the Pentagon's national security judgment based on a business dispute over contract terms, not free speech. Vendor restrictions mid-mission are a genuine operational risk, and no court has actually settled whether a private supplier gets veto power over military use. A second lawsuit is still pending, so this fight is far from over.
