Is this a win against authoritarian speech suppression or a legal loophole letting antisemitism go underground?

The Spin

Establishment-critical narrative

Judge Stearns was right to dismiss this lawsuit, which was never about protecting Jewish students. It was about punishing Harvard for pro-Palestinian protests President Trump couldn't shut down any other way. Weaponizing antisemitism claims to crush campus speech is authoritarianism wearing a legal disguise.

Pro-establishment narrative

The same judge who once said Harvard failed its Jewish students has now handed the school amnesty by inventing a legal requirement that violations must continue after notice. Congress never wrote that condition into Title VI. Quiet does not mean cured, and this ruling lets sophisticated violators off the hook simply by going underground or being silent once caught.
