Republican narrative

Federal immigration enforcement requires practical tools to identify individuals who may be in the country illegally, especially in regions with high undocumented populations. Common-sense factors, including language, work location and even ethnicity help agents focus limited resources where violations are most likely to occur. The lower court's restrictions would have created an impossible enforcement environment.

Democratic narrative

This decision greenlights systematic racial profiling in violation of the Fourth Amendment. Federal agents are now free to target anyone based on appearance or the language they're speaking. We've already seen U.S. citizens be wrongfully detained, injured and denied access to lawyers. The mountain of evidence shows these aren't brief questioning stops but violent seizures using firearms and warehouse detentions.
