ICC Denies Duterte's Release in Crimes Against Humanity Case

Is Duterte's detention necessary to protect justice and witnesses, or is it beyond the court's jurisdiction?

The Spin

Pro-establishment narrative

Keeping Duterte in custody is the right call. Judges unanimously found serious risks, and the defense offered no workable safeguards. The ICC applied the Rome Statute, rejecting thin humanitarian claims to protect the case and uphold justice.

Establishment-critical narrative

Duterte's detention makes no sense. ICC jurisdiction over the Philippines is shaky at best, and an ailing 80-year-old with declining faculties poses no escape or retaliation risk. Releasing him to family or to the hospital honors the law and basic humanity.
