The Facts

  • New York Judge Juan Merchan on Monday rejected Pres.-elect Donald Trump's latest effort to have the sentencing in his state business fraud case delayed from its Jan. 10 date.

  • In his ruling, Merchan found that arguments from Trump's lawyers were "a repetition" of one made "numerous times in the past." Merchan already postponed the sentencing from July 11 because of questions surrounding presidential immunity.

  • On Jan. 3, Merchan rejected Trump's motion to dismiss the case. The judge also indicated he would likely impose an unconditional discharge without jail time.

The Spin

Republican narrative

The case represents continued unlawful political weaponization of the justice system against Trump. This lawfare violates established legal precedent on immunity and threatens the functioning of the federal government.

Democratic narrative

The court has the right to end this matter before Trump's inauguration to ensure accountability. Trump's conviction relates entirely to unofficial conduct that occurred before he took office and poses no danger to his authority or the SCOTUS immunity ruling.
