Sexual predators have hidden behind wealth, power and the clock for far too long, banking on survivors staying silent while statutes of limitations shield abusers from accountability. Trauma delays disclosure, and justice cannot be held hostage to arbitrary calendars. Ending these time limits ensures that those who committed these crimes don't get to run out the clock on facing consequences.
Reviving expired statutes of limitations violates constitutional protections against retroactive laws that strip defendants of vested rights earned through the passage of time. Once a limitations period expires, the state has effectively granted amnesty, and retroactively prosecuting or allowing suits creates unfair surprise and denies fair warning. The Constitution forbids legislatures from acting as courts by retroactively negating legal defenses.
