The incident occurred when McIver and other Democratic lawmakers were conducting congressional oversight at the facility while Newark Mayor Ras Baraka was being arrested for trespassing. According to the indictment, McIver allegedly placed her arms around Baraka to prevent his arrest and "slammed her forearm" into one officer while using "each of her forearms to forcibly strike" a second officer.</span
