Previously, a document dated February 26 and disclosed in March from the nation's spy agencies said that they determined the gang wasn't under control of the Venezuelan government — contradicting Trump's basis for invoking the 1798 Alien Enemies Act to deport those suspected of being members of that gang.

A second assessment, which was published April 7 and made public in early May, largely confirmed the first assessment's findings. In a March 24 email, Kent described a link between Venezuela and the gang as "common sense" and he called for a "rethink" of the intelligence community's findings.
