Student loan payments will be paused for 8 million borrowers after appeals court temporarily halts Biden’s repayment plan

On Thursday, the 8th Circuit Court of Appeals granted a motion to stay the remaining pieces of the Biden administration's student loan forgiveness plan that had not already been blocked by the courts.

Last month, a district judge had blocked student loan forgiveness but stopped short of blocking the Saving on a Valuable Education (SAVE) Plan entirely. This motion, brought forth by the attorneys general of Republican-led states, would block the rest.

The district judge allowed the lowering of monthly payments for borrowers to come into effect. The motion this week argued that the provisions to scrap payments for those under a certain income and forgive loans after 10-25 years of payments in certain instances were illegal in light of other rulings.

The complaint was filed on behalf of Missouri, Arkansas, Florida, Georgia, North Dakota, Ohio and Oklahoma. The Biden administration has forgiven over $168B in debt for nearly 5M borrowers.

The same day that the ruling was announced, the White House forgave $1.2B for 35K public servants under the Public Service Loan Forgiveness, which includes teachers, nurses, and first responders.

The two June injunctions which paused some portions of the plan ruled that the Department of Education (DOE) does not have a mandate from Congress to forgive debt and that loan forgiveness illegally stripped states of revenue. The DOE says it will "aggressively defend" the SAVE Plan, as the ruling is not final.
