Biden’s Title IX Rules Force Schools to Use Transgender Pronouns

On Monday, a federal district judge in Kentucky granted a preliminary injunction against the Biden administration's changes to Title IX in six states. The change would expand protection under Title IX to LGBTQ+ students, particularly transgender ones.

Enforcement is now blocked in Kentucky, Indiana, Ohio, Tennessee, Virginia and West Virginia, with an earlier rulings blocking it in Idaho, Louisiana, Mississippi, Montana and Texas.

Title IX is a 1972 civil rights law that bars sex discrimination in education. Kentucky judge Danny C. Reeves called the expansion of sex discrimination to encompass LGBTQ+ students "arbitrary in the truest sense of the word" in his ruling.

Enforcement is now blocked in Kentucky, Indiana, Ohio, Tennessee, Virginia and West Virginia, with an earlier ruling blocking it in Idaho, Louisiana, Mississippi and Montana. 20 GOP-governed states are challenging the change to Title IX.

This comes as Chief Judge Danny C. Reeves said in his ruling that the change in the 1972 federal civil rights law barring sex-based discrimination in education and athletics to encompass LGBTQ+ students was "arbitrary and capricious."

He further wrote that the new rules redefining sex-based protections to include gender identity would conflict with Title IX and "the broader guarantee of education protection for all students" by mandating schools to permit "biological men into women's intimate spaces, and women into men's."

Reeves wrote that the change redefines "‘sex’ to include ‘gender identity’,” and that it would conflict with the text of Title IX by permitting "biological men into women’s intimate spaces, and women into men’s," causing harm to both sexes.

The Alliance Defending Freedom filed the case, State of Tennessee [et al.] v. Cardona, on behalf of a 15-year-old girl and a Christian educators association after a trans track athlete was allowed to compete against middle school girls.

Opponents have argued that the redefinition would  violate the rights of women and girls by allowing those who identify as female to access women's spaces. Reeves wrote that sex-separate facilities and programs are integral to Title IX.

Earlier this year, the US Supreme Court passed up a chance to intervene in the debate over whether transgender students have a legal right to use school bathrooms that match their gender identity.

The GOP has used the transgender community as a scapegoat, as basic protections for the LGBTQ+ community come under repeated assault. This change would grant no special privileges to any group, and would merely extend to trans students the rights that everyone else is entitled to have. The Title IX change would obligate schools to protect LGBTQ+ students and ensure they are treated fairly.

It's impossible to change your sex, and equating sex with gender identity is illogical and serves nobody but the purveyors of woke gender ideology.
