Will Israel Lose International Support for Its Campaign in Gaza?

US National Security Adviser Jake Sullivan met with Israeli Prime Minister Benjamin Netanyahu and other top officials in Israel on Monday. Sullivan held “constructive” talks regarding normalization with Saudi Arabia.

Karim Khan, the chief prosecutor of the International Criminal Court, on Monday applied for arrest warrants for Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant, as well as three Hamas leaders Yehia Sinwar, Mohammed Deif, and Ismail Haniyeh.

Khan said he had "reasonable grounds to believe" that the Israeli and the Hamas officials bear criminal responsibility for alleged war crimes and crimes against humanity over the Oct. 7 attacks on Israel and the ensuing Gaza war.

Sullivan's visit comes as tensions in Israel's war cabinet have escalated, with both opposition National Unity party leader Benny Gantz and Defense Minister Yoav Gallant both criticizing Netanyahu in the last week. In response, right-wing members of the coalition like Itamar Ben-Gvir said that Netanyahu should sack Gallant.

While the charges against Sinwar, Deif, and Haniyeh include extermination, murder, rape, and sexual violence, Netanyahu and Gallant are accused of causing starvation as a method of warfare, murder, and intentionally directing attacks against a civilian population.

A pre-trial panel of three ICC judges will now consider Khan's evidence and determine whether the arrest warrants can be issued formally. Netanyahu and Gallant don't face any immediate risk of prosecution as Israel isn't an ICC member.

Meanwhile, heavy fighting continued in Gaza on Monday, with Israeli forces reportedly advancing even deeper into Jabalia in the enclave's north. An Israeli official said that Netanyahu wanted to convince Sullivan that Israel must press ahead with its offensive in Rafah.

Last year, the ICC issued an arrest warrant for Russian Pres. Vladimir Putin for the war crime of "unlawful deportation of population (children) and that of unlawful transfer of population (children) from occupied areas of Ukraine to the Russian Federation."

Monday's announcement comes days after Egypt joined South Africa's lawsuit at the International Court of Justice, accusing Israel of breaching international humanitarian law and "the Fourth Convention of 1949 for the protection of civilian persons in time of war" in its war against Hamas.

Israel must be able to defend itself from terrorist attacks from Gaza or elsewhere, and the US is committed to preventing malicious actors from threatening Israel's legitimate concerns. However, the humanitarian situation in Gaza has gotten out of hand, and the Biden admin. will not support any further offensive action in Rafah. Netanyahu must keep his promises and work with US allies to find a resolution to this conflict.

Biden’s Warning Over Rafah Sharpens a Problem for Netanyahu

The aftermath of Oct. 7 has presented a challenge to the US and Israel, but the rhetoric being deployed against Netanyahu is unreasonable. Any change in leadership during these uncertain times would essentially paralyze the war effort and weaken Israel to a point where it could very well lose this existential struggle with terror. The only winner resulting from the left's attack on Netanyahu is Hamas.

The West likes to portray men like Benny Gantz as "moderate" compared to Netanyahu and his "extremist" allies like Ben-Gvir. However, this hides the fact that, when it comes to the war or Palestinians more broadly, most Israeli politicians are indistinguishable. Indeed, the Israeli population overwhelmingly supports Israel's cruel policies toward Palestinians.

Israel has the right to defend itself from terrorist attacks and an obligation to get hostages back from malicious actors. It's beyond outrageous to draw a parallel between the leader of a democratic country and the leader of a terrorist group. ICC's action is a deep distortion of justice and a complete moral failure.

ICC's attempt to issue arrest warrants against Hamas leaders is akin to equating the victim with the executioner.
