EMTALA was passed to allow doctors to uphold their oath to do no harm no matter the situation. Women often face life-threatening complications, such as miscarriages, and it's neither their nor their doctor's fault if an emergency abortion is required. The unfortunate reality for Republican states is that if SCOTUS does grant their wish, they will face a serious doctor shortage, as no physician will practice in a state that criminalizes emergency care.
The Biden administration is trying to expand the scope of EMTALA by executive fiat, essentially grouping together simple health troubles with life-threatening emergencies. Not only was it written solely to prevent death, but it also included provisions surrounding the need to protect the unborn. Rather than withhold federal funds from Idaho — which was the original intent of EMTALA — the government is trying to impose pro-choice laws on pro-life states.
